LITIGATION/JURY RESEARCH/TRIAL CONSULTING

Opinion Studies has been engaged in litigation research for nearly 25 years beginning with the Exxon Valdez litigation.  Our services range from design and implementation of community attitude and change of venue studies to facilitation of mock trials, focus groups and shadow juries, and recruitment of mock jurors.  Opinion Studies also maintains an extensive data base of venue reports which profile all state and federal jurisdictions and is often called on to identify surrogate sites when pretrial research cannot be conducted in the trial venue. 

  • A plaintiff attorney was preparing to certify a class action suit against a major telecommunications company.  Opinion Studies conducted an extensive telephone survey among potential class members to support class claims.  Class was certified.
  • A defense attorney was preparing to defend a household goods manufacturer in a trademark infringement case.  Opinion Studies conducted an experimental project to test plaintiff claims.  Findings supported the defense's position in the case and the defense prevailed.  
  • A trial consultant working on behalf of a high profile land developer needed information to guide jury selection.  A mock trial was not an option.  In a short period of time, Opinion Studies conducted a community attitude survey which delineated the demographic profiles of people who were more sympathetic to the plaintiff's arguments as well as those more sympathetic to defense arguments. The defense team (the client) won a favorable verdict and pointed to jury selection as a key reason for its success.

In addition to case-related projects, Opinion Studies has provided field support for a number of empirical studies related to juror decision making.  The largest of these efforts (3,600 mock jurors) culminated in the publication of Punitive Damages:  How Juries Decide and was used by ExxonMobil to argue successfully before the U.S. Supreme Court regarding punitive damages in the Exxon Valdez litigation.

Over the years, Opinion Studies has worked on a wide variety of civil cases including medical malpractice, patent infringement, contract disputes, employment disputes, toxic waste and personal injury matters. Opinion Studies has been contracted to work on behalf of many Fortune 500 companies including Ford Motor Company, ExxonMobil, Microsoft, Apple, Samsung, Chevron, Travelers Insurance, to mention a few.
